dissenting in part.

| ^though I full heartedly agree with the majority’s disposition of the appeal, I disagree with the denial of an award of attorney fees to plaintiffs for their defense of this appeal since EKL offered no reasonable or legally viable basis for challenging the trial court’s judgment that incorporated the jury’s verdict.
