SECTION D (1) ORDER The Court, having considered the Petition Under 28 U.S.C. § 2254 for Writ of Habeas Corpus By A Person In State Custody,1 the record, the applicable law, and the Report and Recommendation of the United States Magistrate Judge,2 to which there are no objections,3 and having determined that the Report and Recommendation is not clearly erroneous or contrary to the law, hereby approves the Report and Recommendation of the United States Magistrate Judge and adopts it as its opinion in this matter. Additionally, Rule 11(a) of the Rules Governing 28 U.S.C. § 2254 proceedings provides that, “The district court must issue or deny a certificate of appealability when it enters a final order adverse to the applicant.” A court may only issue a certificate of appealability if the petitioner makes “a substantial showing of the denial of a constitutional right.”4 The “controlling standard” for a certificate of appealability requires the petitioner to show “that reasonable jurists could debate whether (or, for 1 R. As such, the Court will not issue a certificate of appealability. Accordingly, IT IS HEREBY ORDERED that the Petition of Christopher Alexander for the issuance of a writ of habeas corpus under 28 U.S.C. § 2254 is DISMISSED WITHOUT PREJUDICE.
