  • This was a libel for a divorce from the bonds of matrimony. 1'he libel was duly filed in the clerk’s office; and a summons was thereupon issued, directed to the sheriff, his deputy, or any constable of Boston, and it was served and returned by a constable. The Court dismissed the libel, on the ground that a constable had no authority to serve the summons.
