I concur in the conclusion, upon the ground that, under the rule laid down in Cruikshank v. St. Paul F. & M. Ins. Co., 75 Minn. 266, 77 N. W. 958, the court below should have granted a new trial, instead of ordering judgment for defendant notwithstanding the verdict.
