The following order has been entered on the motion filed on the 5th day of January 2005 by Petitioner (Norris Dillahunt) for "Notice of Appeal" to the N.C. Supreme Court of the Denial of the Writ of Supersedeas on December 20, 2004, for Lack of Jurisdiction and N.C. Rule 12, Sec. 11:

"Motion Dismissed ex mero motu by order of the Court in conference this the 3rd day of February 2005."
