concurring.

I concur in the result reached in this case and in the opinion generally. Where multiple defendants have been apprehended and are tried for the same criminal offense, jurors who have sat upon and determined one case are disqualified to sit upon a second or third case necessarily tried upon the same facts. This does not, however, disqualify other members of the jury panel.
