concurring specially: I concur specially in the judgment of the court, as I understand it not to foreclose such further litigation as may be appropriate under the Dumas doctrine. See Dumas v. State Farm Mut. Auto. Ins. Co., 111 N.H. 43, 274 A.2d 781 (1971).
