Concur: Chief Judge Desmond and Judges Dye, Fuld, Froessel, Burke and Foster. Judge Van Voorhis dissents and votes to reverse upon the ground that the Board of Standards and Appeals had power to act and acted correctly under section 110 of the Labor Law.
