Smith v. Loonin , 228 A.D. 840 ( 1930 )

Menu:
  • Judgment reversed upon the law and the facts and a new trial granted, costs to abide the event. We are of opinion that the questions relative to ambulance chasing were prejudicial to plaintiff and that, therefore, a new trial should be granted even though no objection was made to the questions. Lazansky, P. J., Young, Hagarty, Carswell and Tompkins, JJ., concur.
