(dissenting): For the reasons stated in my dissenting opinion upon the first appeal (56 Ápp. Div. 313) I think the plaintiff was entitled to recover and_that the judgment should, therefore, be reversed. Judgment modified as directed in opinion, and as modified affirmed, without costs.
