Judgment and order reversed and new trial granted, costs to abide the event, for error in the charge of the learned trial court at folio 128 of the case on appeal respecting contributory negligence on the part of the decedent. Jenks, P. J., Burr, Carr, Rich and Stapleton, JJ., concurred.
