No opinion. Order modified by striking out that part of the order which requires.the appellant, Theodore Jacobi, to give a bond for $250 as a condition for leave to answer; and the order, as amended, is affirmed, with $10 costs and disbursements to Theodore Jacobi against the plaintiff.
