(Id. at 2.) Singleton also submitted a “Miscellaneous Case Cover Sheet”which lists the Peopleof theState of NewYork as the plaintiff and Singleton asthe defendant. (ECF2.) Becausethe nature of Singleton’sfilings do not fit anyof thelisted categoriesof miscellaneous matters, this case cannot proceed under the miscellaneous docket. TheClerk of Courtis directed to openthis case as anew civil action with Singleton listed asthe plaintiffand the People ofthe State ofNewYork listedasthe defendant.TheClerk of 1 Singleton paid the$49.00 feeto file amiscellaneous casein this court. Court is further directed to terminate any pending motions and administratively close this miscellaneous case. The Court certifies under 28 U.S.C. § 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal.
