Daniels, J., (concurring.) I think that the evidence of the witnesses, together with the probability arising out of the mode of transacting the business, supports the conclusion that the notice of the dishonor of the note was in fact properly and legally given; and the order should be reversed, and the motion denied, as directed by Mr. Justice Ingraham.
