On consideration, the court is of the opinion that the petition of the plaintiff below states a cause of action, and that the circuit court erred in holding that it did not; but, that court having also held that the verdict is against the weight of the evidence, which is not reviewed in this court, the judgment of the circuit court is affirmed.
