  • The bill of exceptions contains substantial evidence tending to prove a variety of circumstances from which reasonable minds may *Page 284 properly reach opposite conclusions on the issues of actionable negligence of defendant and contributory negligence of plaintiff.

    Therefore the direction of a verdict for defendant was erroneous and a new trial should be awarded.
