concurring in part and dissenting in part.

T 1 I concur in the majority opinion's treatment of Roye Realty & Developing, Inc. v. Watson, 2 P.8d 320 (Okl.1996) [republished at 2 P.3d 320]. However, because I agree with the Court of Civil Appeal's handling of the constructive fraud issue, I dissent to the majority's departure therefrom.
