concurring and dissenting.

[¶ 37] It is apparent that Richard Wal-stad’s concealment of marital assets unreasonably increased litigation costs. To that extent I agree with the majority that the district court abused its discretion in not awarding attorney fees under the facts of this case. However, I agree with the dissent’s analysis of the distribution of the marital assets. I would therefore affirm that portion of the order distributing the marital assets and reverse that portion of the order denying the award of attorney fees to Catherine Walstad.
