GIVENS, Justice.

I concur with the opinion written by THOMAS, J., except as to the allowance qf attorneys’ fees, and dissent from that portion because, to apply the statute enacted after the insurance policy was written impairs the obligation of contract. Authorities supporting this proposition are cited in the majority opinion and it is unnecessary to add thereto, although there are others to like effect.
