VAN BOKKELEN, District Judge, concurring in part and concurring in the judgment.
For the reasons stated in Blausey v. U.S. Trustee, 552 F.3d 1124 (9th Cir.2009), I agree with Judge Posner’s conclusion
*357 that the bankruptcy trustee’s failure to file a petition for permission to appeal in this Court does not prevent the Court from reaching the merits of the case. Moreover, I join in Judge Posner’s opinion reversing the bankruptcy court’s order overruling the trustee’s objection to confirmation of the debtor’s Chapter 13 plan.
