— I dissent for the reasons expressed in my dissenting opinion in Dyas v. Superior Court (1974) 11 Cal.3d 628, 637-638 [114 Cal.Rptr. 114, 522 P.2d 674], The judgment should be affirmed.

Respondent’s petition for a rehearing was denied June 27, 1979. Clark, J., was of the opinion that the petition should be granted.
