concurring in part and dissenting in part: I would affirm the judgment with respect to Steve Hall, a minor, on the basis of the court’s holding in Syllabus No. 2, and Montague v. Burgerhoff, 150 Kan. 217, 223, 224, 92 P. 2d 98. (See my dissenting opinion in Ralls v. Caliendo, 198 Kan. 84, 422 P. 2d 862.) Otherwise, I concur in the court’s conclusion setting aside the judgment as to Elden L. Beebe, Executor of the estate of Myron Hall, deceased.
