BAZELON, Chief Judge: While I concur in the opinion of the Court in Ash in its statement of the principles calling for reversal of the conviction, I am of the view, for the reasons set forth in my opinion dissenting in Brown and concurring in Ash, that logic and fairness require application of those principles to all persons in custody.
