(concurring). I think there should be added to the opinion the statement that inasmuch as the court had discretion to grant or refuse the writ, refusal to issue it to quash the judgment was not res judicata in respect of the contention that.the judgment was void. See Corpus Juris, ‘ ‘ Certiorari, ” vol. 11, § 385.
