Mr. Chief Justice Smith,

dissenting: In my opinion the question of whether the relation of employer and employee was established, and all other questions in the case were questions of fact; that the findings of the Industrial Commission are not against the manifest weight of the evidence, but are supported by substantial evidence in the record. In this situation the findings of the commission are conclusive and should not be set aside by the court.
