concurring specially. I concur in the judgment, and in all of the rulings announced by the court; but I am of the opinion that the assignments of error dealt with in the fourth, eighth, tenth, and eleventh divisions of the opinion are meritorious, and of themselves require a reversal of the judgment refusing a new trial.
