Per Curiam,

After this case had been argued and was sub judice in the court, the appellant moved for leave to discontinue. As this is objected to by the appellees and would apparently be to tbeir prejudice, leave must be refused.

The judgment is affirmed on the opinion .of the court below on the ease stated.
