Per. Curiam:

As the court below must necessarily be governed by the decisions of this court, it could not properly refuse to dismiss tbe exceptions to the auditor’s report; and as that report well states the law governing this contention, we affirm the decree for the reasons therein given.

The decree is affirmed and the appeal dismissed, at the costs of appellant.
