Per Curiam,

The judgment in this case was entered on relator’s demurrer to the answer of respondents to the petition for the writ of mandamus, and it is affirmed, except as to Harvey D. P. Dietrich, on the clear opinion of the learned president judge of the court below, in pursuance of which it was entered.

Judgment affirmed.
