Judge Gibson,

before whom the cause was tried at Nisi Prius, having declared, that, in his opinion, the verdict was greatly against the evidence, and the justice of the case, the Court, after having heard Milnor in behalf of the defendant, ordered a new trial, without hearing Phillips in support of his motion.

New trial granted.
