    concurring.

    I agree that the judgment should be affirmed, but I would decline to give preclu-sive effect to the driver’s license suspension hearing solely on the ground that a license suspension hearing is an administrative, rather than a judicial proceeding. Cf. Davenport v. State, 574 S.W.2d 73, 75 (Tex.Crim.App.1978); 8 Tex.Jur 3d Automobiles § 167, p. 198.
