Per Curiam.

The Court hesitate upon the first point. As to the second, they are rather inclined to consider, that the declaration is amendable. But as there is not a full bench, they defer an opinion until the next term, to which they direct the cause to be. continued.

For the final decision, vide May adjourned term, Pennington County, A. D. 1802.
