dissenting.

Oliver’s testimony pertaining to whether it was practicable to park the truck in the lot was clear and unrefuted. Pickett produced no evidence to create a genuine issue of material fact as to whether Oliver was guilty of negligence.

Because Pickett did not present substantial evidence to prove Oliver’s negligence, I would affirm the judgment based on the directed verdict in favor of Oliver and Chambers Bottling Company.
