concurring in the rationale in part and concurring in the result.

I concur in that portion of the main opinion concluding that the trial court acted outside its discretion in appointing Guthrie Jeffcoat as a “disinterested” surveyor pursuant to § 35-3-22, Ala.Code 1975. As to that portion of the main opinion concluding that Envision’s counterclaim is barred by Dixon I, I concur only in the result.
