dissenting in part and concurring in part.

I would reverse this case because the defendant did not receive a preliminary hearing after a proper request. I adhere to my dissent in Duncan v. State, 369 So.2d 885 (Ala.Cr.App.1979). I concur with the remainder of the majority opinion.
