PER CURIAM: Appellant seeks review of the Benefits Review Board's decision and order affirming the administrative law judge's denial of black lung benefits pursuant to30 U.S.C.A. §§ 901-945
(West 1986 & Supp. 1997). Our review of the record discloses that the Board's decision is based upon substantial evidence and is without reversible error. Accordingly, we affirm on the reasoning of the Board. Yates v. Little Six Corp., No. 94-2343-BLA (Jan. 26, 1995). We deny the em- ployer's motion to strike the Director's brief, but nonetheless de- cline to consider issues not raised before the Board. See Big Horn Coal Co. v. Director, Office of Workers' Compensation Programs, Dep't of Labor,897 F.2d 1052
, 1054 (10th Cir. 1990); see also Pleasant Valley Hosp., Inc. v. Shalala,32 F.3d 67
, 70 (4th Cir. 1994). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the court and argument would not aid the decisional process. AFFIRMED 2
