Prestwood v. Hunt, No. CA-96-564- 5-H-3 (E.D.N.C. Aug. 21, 1996). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the court and argument would not aid the deci- sional process. DISMISSED 2
