(dissenting).

I respectfully dissent. The appellant City through its own agency, the examining physicians, caused the cancellation of the fight scheduled for April 10, 1963, which was the date provided for in the lease agreement as amended. I would affirm. The City should not be in a position to take a benefit from a cause of action it set in motion.
