concurs in the result only because: (1) the playlet produced by the prosecution at trial to obtain an “eyeball” identification was so suggestive, inflammatory and void of probative value that it deprived the defendant of due process of law and a meaningful trial by jury; and (2) there was sufficient independent circumstantial evidence of identity to carry the case to the jury.
