I concur, there being no conflict between the foregoing opinion and that in Dyer v. Walker, 51 Maine, 104. The question there decided was what constitutes an " open and mutual account current” within the 99th section of the statute of limitations. The question here is what is the effect of payment referred to in the 111th section of the same statute.
