¶ 16. I agree with the majority that the Hospital was required to pay both the tax and the bond in this case. I write separately to emphasize that the Hospital did not ask the circuit court to waive, excuse, or reduce the bond; it merely declined to pay the bond and argued that it had a choice of paying the bond or paying the tax. Whether a circuit court has the power to waive, reduce, or excuse the bond therefore is not before this Court.
