dissenting.

I respectfully dissent. Neither sarcasm, ridicule, big words or the facts set forth persuade me that we should affirm tampering with or stealing an automobile. The facts do appear sufficient to sustain a charge of fraud or conspiracy to defraud. Retrial of this movant on such a charge is a small price to pay for maintaining fairness and integrity of the law.
