You have asked whether an acting village justice may hold over in office beyond the expiration of his term until his successor is chosen.

The Public Officers Law provides that all public officers "except ajudicial officer, notary public, a commissioner of deeds and an officer whose term is fixed by the constitution * * * shall * * * hold over and continue to discharge the duties of his office, after the expiration of the term for which he shall have been chosen, until his successor shall be chosen and qualified" (emphasis supplied) (Public Officers Law, §

We conclude that an acting village justice may not hold over beyond the expiration of his term of office until his successor is chosen and has qualified.
