Ordered that the judgment is modified, on the law, by vacating so much thereof as ordered restitution in the amount of $67,170.27 upon defendant’s conviction of grand larceny in the fourth degree; matter remitted to the County Court of Chemung County for further proceedings not inconsistent with this Court’s decision; and, as so modified, affirmed.
