Casey v. Schwitter

In an action to impress a trust, order denying plaintiffs’ motion to vacate a dismissal, under rule 17 of the Kings County Supreme Court Rules, and to restore the action to the calendar, the motion having been made four years after the action was marked off the trial calendar, affirmed, without costs.
