Defendant has appealed from an order of the Broome County Special Term of Supreme Court, appointing a receiver of the equipment, personal property and assets located in a restaurant known as Mahoneys in the city of Binghamton. The court was justified in making the appointment. Order affirmed, with $10 costs and disbursements. Hill, P. J., Heffernan, Foster and Russell, JJ., concur; Brewster, J., taking no part.
