The real ownership of this bank deposit and how far it was known to Mr. Rosenzweig seem doubtful, and we, therefore, afford the plaintiff a new trial. Hence the judgment and findings numbered 4, 5 and 6, are severally reversed, with the conclusion of law, as against the weight of the evidence, and a new trial is granted, with costs to appellant to abide the event. Blaekmar, P. J., Mills, Rich, Putnam and Jaycox, JJ., concur.
