Order modified as indicated in order and as so modified affirmed, with ten dollars costs and disbursements to the appellant; and upon defendant’s failure to comply with any of the provisions thereof, the order appealed from is reversed, with ten dollars costs and disbursements to appellant, and the motion denied, with ten dollars costs.
