(dissenting):

I dissent upon the ground that, in my opinion, a receiver should be appointed unless the individual defendants give an undertaking as security for any judgment recovered by the plaintiff.

Order reversed, with ten dollars costs and disbursements, and motion denied, with ten dollars costs.
