This action originated before the board of trustees of the firemen's relief and pension fund in and for the city of Tulsa. Vena B. Naughton filed an application with said board for a widow's pension under the ordinances of the city of Tulsa and the statutes of this state (section 21, art. 2, Revised Ordinances City of Tulsa, 1931, and section 6103, O. S. 1931). Said application was denied by the pension board and an appeal was prosecuted to the district court of Tulsa county, where the order of the pension board was reversed and the pension ordered paid. The board of trustees of the firemen's relief and pension fund in and for the city of Tulsa appeal. As grounds for reversal it is urged that the appeal from the decision of the pension board is not authorized by law, and that the district court did not properly determine the matter on appeal, and that the record contains ample evidence to sustain the decision of the pension board, and that the judgment of the trial court was erroneous as a matter of law. The questions thus presented are substantially the same as those presented and decided in the case of In re Benson,
Judgment affirmed.
